These Terms of Use ("Terms") govern your use of https://jewelry-diamonds.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is, and what it is not

The Site publishes general information about diamonds and diamond jewelry. We are not a jeweler, retailer, appraiser, or gemological laboratory. We do not sell diamonds, jewelry, or any other product, and we do not appraise, grade, test, or verify any stone or metal.

General information only; no appraisal, grading, or investment advice

Content on the Site is for general information. It is not a professional appraisal, a gemological grading, a metal assay, or financial, investment, or legal advice. We do not say that any stone, metal, or piece of jewelry has any grade, weight, origin, treatment status, or value.

How we describe diamonds and metals

Where the Site explains how diamonds, laboratory-grown diamonds, treatments, weights, and precious metal marks are described, it does so as the Federal Trade Commission's Guides for the Jewelry, Precious Metals, and Pewter Industries (16 CFR Part 23) state them, for general information only. Those Guides can change, and they are not legal advice to you.

Mined and laboratory-grown diamonds

A laboratory-grown diamond and a mined diamond are both diamonds. When the Site refers to a laboratory-grown diamond, it says so. Whether a particular stone is mined or laboratory-grown, and whether it has been treated, is the seller's statement, not ours. Read the seller's description and any grading report before you buy.

Weights, grades, and reports

Carat weights, grades, and other details are set by the seller and by any laboratory that issued a report. A grading report is the issuing laboratory's statement. We do not issue, verify, or vouch for any report, and naming a laboratory on the Site is not an endorsement by or of that laboratory.

Sourcing and origin

We do not make claims about where any stone or metal came from or how it was produced, mined, or traded. If sourcing matters to you, ask the seller what it can document, and read that documentation yourself.

Care and cleaning

Care information on the Site is general and summarizes its source. Treatments, settings, and materials vary. Follow the seller's care instructions for any piece, and ask the seller before using an ultrasonic or steam cleaner or any solvent.

Agencies, laboratories, and sources

Government agencies, laboratories, and other organizations named on the Site, including the Federal Trade Commission and the Gemological Institute of America (GIA), are credited for their own guidance or descriptions, which the Site summarizes in its own words. They do not endorse the Site.

The Site name

"Jewelry Diamonds" is the name of the Site. It is not a store or a jeweler, and it is not a claim about any product.

Brand names and trademarks

Brand, product, program, and organization names mentioned on the Site belong to their owners. We use them only to credit their own guidance or to describe facts. The Site is not affiliated with, sponsored by, or endorsed by any brand or organization it mentions.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PURCHASE FROM A THIRD PARTY, OR THE CHOICE, PURCHASE, VALUE, OR USE OF ANY DIAMOND, STONE, METAL, OR PIECE OF JEWELRY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
